At ParkMobile, we are strongly committed to respecting and protecting your privacy. This privacy policy (“Policy”) is designed to help you understand how we collect, use, and share Personal Data that we collect through the ParkMobile websites, mobile applications, and other services we operate (collectively the “Services”). Any individual who provides Personal Data to ParkMobile, consents to the collection, use and disclosure of such data under the terms of this Policy.  Because we're an internet company, some of the concepts below are a little technical and can be confusing, but we've tried our best to explain things simply and transparently. If you have any questions about our privacy policy, please let us know.

What Data We Collect

You may be asked to provide Personal Data anytime you interact with us or one of our affiliates when you use our Services. For purposes of this Policy, “Personal Data” means information we process that identifies or can be used to identify or authenticate an individual or similar term (such as “Personal Information” or “Personally Identifiable Information”) under applicable law. Personal Data does not, however, include publicly available information from government records, deidentified or aggregate information, or information excluded from the scope of applicable data privacy laws.

The type of data we collect depends on how you use our Services. We collect data in a few different ways:

1. When you give it to us or give us permission to obtain it

When you sign up for or use ParkMobile Services, you voluntarily share certain data including your name, telephone number, email address, payment card information, vehicle information, and any other data you give us. 

When you create an account, you will be asked to provide an email address, or you may log in with an associated Apple or Google account–to access your ParkMobile account information. You are responsible for maintaining the confidentiality of your accounts used to log in to ParkMobile. 

When you use ParkMobile to make a parking transaction, we collect data related to the transaction, such as the parking facility, date and time of arrival and departure, services purchased, location data, and other transactional data. You also have the option to share other Personal Data about yourself such as your gender, age, and preferred language.

If you enroll in our Automated License Plate Recognition (“ALPR”) program, we may take a picture or otherwise record your license plate when you use our Services with certain parking facilities. 

Lastly, you may provide Personal Data to enter into contests or other marketing promotions. 

2. When a third-party gives it to us

We may collect your data when a third-party provides your data to us to use our Services. For example, your friend may provide us with your license plate number if she pays to park your car using her ParkMobile account. If your employer has a business account with ParkMobile, your employer may provide us with data necessary to set up your account.

3. We collect technical data when you use our Services

When you use a website, mobile application, or other internet service, certain internet and electronic network activity data is created and logged automatically. This is also true when you use ParkMobile. Here are some of the types of data we collect:

  • Internet or other electronic network activity data, such as information about your interactions with our Services. This includes information about the content you view, the time you spend viewing the content, and the features you access on the Services;

  • Identifiers, such as your Internet Protocol (IP) address, device identifiers (including the manufacturer and model), and Media Access Control (MAC) address;

  • Geolocation data, such as where you are located when you use our Services; and

  • Standard server log data, such as your application version number, computer type (Windows or Macintosh), screen resolution, operating system, browser type and version, and the date and time of your visit.

We collect this information about you by using cookies, pixels, and other similar technologies. For more information, please refer to the ‘How We Use Cookies’ section of this Policy.

How We Use Your Data

We collect and use your data so that we can operate effectively and provide you with the best experience when you use our Services. Those purposes may include, but are not limited to:

  • Fulfillment of parking transactions and other purchases, such as completing your parking transaction; supplying the purchased Services; and communicating with you about and keeping proper records of those transactions;

  • Customer support, such as notifying you of any changes to our Services; responding to your inquiries via email, phone, writing, chatbox, or social media; investigating and addressing concerns raised by you; and monitoring and improving our customer support responses;

  • Improving our Services, such as conducting data analysis and audits; developing new products and services; enhancing our websites and mobile apps to improve our Services; identifying usage trends and visiting patterns; conducting customer satisfaction, market research, and quality assurance surveys; determining the effectiveness of our promotions; and meeting contractual obligations;

  • Marketing and promotions, such as sending you emails and messages about ParkMobile news; new promotions, features, products and services, and content; providing you with relevant advertising on and off our Services; and administering your participation in contests, sweepstakes, and promotions; and

  • Legal proceedings and requirements, such as investigating or addressing claims or disputes relating to your use of our Services; or as otherwise allowed by applicable law; or as requested by regulators, government entities, and official inquiries.

How and When We Share Your Data

1. Your consent

We may share your data other than as described in this Policy if we notify you, and you agree.

2. Other services

We may share your data with third parties to enable you to sign up for or log in to ParkMobile, or when you decide to link your ParkMobile account to those services.

Where We Store Your Data

We process and store Personal Data inside and outside of the United States in order to fulfill our service commitment to you, including in countries that have privacy protections that may be less stringent than your jurisdiction.

How Long We Retain Your Data

We will retain your Personal Data for: (i) the duration of time necessary for the purposes for which the Personal Data was received or collected in accordance with this Policy; (ii) the period of time to respond to potential legal or regulatory proceedings; or (iii) the time required by applicable law.

How We Secure Your Data

We recognize the importance of security for all Personal Data collected through use of our Services and otherwise subject to this Policy. We maintain reasonable administrative, organizational procedures, technical and physical safeguards, consistent with legal requirements where the Personal Data was obtained, designed to ensure the security and confidentiality against unlawful or unauthorized destruction, loss, alteration, use or disclosure of, or access to, the Personal Data within our control. Although we take steps to safeguard Personal Data, no practices are 100% secure, and no transmission of information via the internet or storage system can be guaranteed to be completely secure. As such, we have procedures to deal with any suspected data security breach, and will notify you and any regulator of a suspected breach, as mandated by law.

How We Use Cookies

We, along with our partners, use various technologies to collect and store data when you use our Services, and this may include using cookies or similar technologies to identify your browser or device. We also use these technologies to collect and store data when you interact with services from our partners, such as advertising services.

These technologies allow us to serve you better. They allow us to understand website and Internet usage and to improve or customize the content, offerings, or advertisements on our Services, and generally improve your browsing experience.. 

The technologies we use for this automatic data collection may include:

1.   Cookies. A cookie is a small file placed on the hard drive of your computer. We use cookies to store data, such as your login credentials and website preferences, so that we can remember certain choices you’ve made. Cookies can also be used to recognize your device so that you do not have to provide the same data more than once.

2.   Web beacons. Pages of our Services or our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us, for example, to count users who have visited those pages or opened an e-mail and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

3.   Mobile device identifiers and SDKs. A mobile SDK is the mobile app version of a web beacon. The SDK is a bit of computer code that app developers can include in their apps to enable ads to be shown, data to be collected, and related services or analytics to be performed.

4.   Other technologies. There are other local storage and Internet technologies, such as local shared objects (also referred to as “Flash cookies”) and HTML5 local storage, that operate similarly to the technologies discussed above.

Disabling cookies

You may be able to refuse or disable cookies by adjusting your web browser settings. Some browsers have options that allow the visitor to control whether the browser will accept cookies, reject cookies, or notify the visitor each time a cookie is sent. Because each web browser is different, please consult the instructions provided by your web browser (typically in the “help” section). Please note that you may need to take additional steps to refuse or disable local shared objects and similar technologies.

Do not track signals and similar mechanisms 

“Do Not Track” (DNT) is a privacy preference you can set in your browser to signal to operators of websites, web applications, and services (including behavioral advertising services) that you do not want such operators to track, collect, and share certain kinds of information about your online activity from party tracking services across different websites.

Manage Your Choices

If you prefer not to receive promotional materials, emails, or other forms of communication, you may choose to opt-out or manage your preferences using the methods below. 

  • Promotional emails and other marketing material. You can unsubscribe from receiving marketing material from us at any time by clicking the unsubscribe link located at the bottom of our emails or by emailing us at privacy@parkmobile.io. Unsubscribing from promotional material will not prevent you from receiving transactional, relationship, or non-commercial content from us.

  • Text Messages. You can opt-out of receiving text messages by texting STOP from the mobile device receiving the messages. Opting-out of receiving text messages may limit your ability to take advantage of our full range of features and services.

  • Push Notifications. You can opt out of receiving push notifications through your device settings. Please note that opting out of receiving push notifications may impact your use of our Services.

  • Accessing Your Account. You can access or correct your account information at any time by logging into your account or by submitting a request to the ParkMobile Help Center.

Third Party Links

Our website or Services may contain links to other websites or services that are not owned or controlled by us, including links to social media platforms, or may redirect you away from our website or Services, to other websites for information or other services. This Policy only applies to data collected by our websites and Services. We are not responsible for the privacy and security practices of those other websites or social media platforms, or the data they may collect (which may include your IP address). You should refer to such third parties’ privacy policies on their sites to determine their respective privacy practices. Links to any other websites or content do not constitute or imply an endorsement or recommendation by us of the linked website, social media platform, and/or content.

Children's Data

Children under the age of majority are not allowed to use our Services. We do not knowingly collect Personal Data directly from any person under the age of majority years of age, and we will not knowingly link to any third-party website that solicits or collects Personal Data from any person under the age of majority years of age. If we learn we have collected or received Personal Data from a child under the age of majority without verification of parental consent, we will delete that data. International Users

ParkMobile is based in the United States of America (“U.S.”), and, regardless of where you use our Services from or otherwise provide Personal Data to us, the Personal Data may be transferred to and maintained on servers located in the U.S. Please note that any Personal Data we obtain about you will be stored in accordance with U.S. privacy laws, regulations and standards, which may not be equivalent to the laws in your country of origin or residence. By using the Services or by providing us with your Personal Data, you consent to this collection, transfer, storage, and processing of Personal Data to and in the U.S.

Automated Number Plate Recognition (“ANPR”)

An “ANPR System” is the operation of one or more mobile or fixed cameras combined with computer algorithms to read and convert images of license plates and the characters they contain into computer-readable and searchable data. The data collected by the ANPR System is called “ANPR Data”.

We may use ANPR Data to help us provide Services, for security, and to prevent fraud. However, we will only use ANPR Data for customers that have enrolled in the camera parking service. If you have not enrolled in this service, we will not use the ANPR Data.

We engage with our partners or other third-parties who install and maintain ANPR systems for parking facilities. Our technology and engineering teams may, under certain circumstances, be able to access ANPR Data. Our legal team and persons responsible for security may also be authorized to access the ANPR Data. The parking facilities in properties that contract our Services also have access to ANPR Data. Persons with access to ANPR Data will undergo training to make sure they only use the ANPR Data in compliance with applicable privacy and security laws.

We have taken all reasonable steps to safeguard the information technology systems utilized in the operation of our business, including the implementation of procedures to ensure that our systems are free from any disabling codes or other software routines or hardware components that would permit unauthorized access by a third party. We will periodically check our ANPR Data access records to monitor legal and security compliance.

We will not sell ANPR Data and will only share ANPR Data with a third-party in the following limited circumstances:

  • With our service providers that help us provide Services to our customers;

  • With parking facilities that use our Services; 

  • For the safety and security of our customers;

  • Protecting the rights of our customers and ParkMobile; and

  • Complying with legal requirements.

When requested by the end user to verify ANPR Data in our possession, we will take reasonable measures to do so and to confirm such information and, if inaccurate, provide information to end users to correct such information.  

ANPR Data will be retained as long as required to verify the legitimacy of charges incurred in our facilities per parking facility auditors unless applicable law requires that we retain ANPR Data for a different length of time. We will destroy ANPR Data when it is no longer needed.

California Residents’ and Other State Privacy Rights

If you are a California resident, or if you reside in one of several other states that have data privacy laws, we are required to tell you certain things about your Personal Data and your rights regarding your Personal Data. that we have collected in the last twelve (12) months. First, let us tell you more about how your Personal Data is collected, used, and shared. Please keep in mind that not all categories of Personal Data (“PD”) will apply to all California residents or residents of other states.

Rights regarding your Personal Data

You have several rights regarding your Personal Data. We will explain those rights to you and how you may exercise them. 

Right to Opt-Out of the Selling or Sharing of Your Personal Data

You have the right to opt-out of us selling or sharing your Personal Data with third-parties for valuable consideration or for certain targeted advertising (as “selling” and “sharing” are defined by data privacy law). We do not “sell” Personal Data. To the extent our use of your Personal Data constitutes sharing, by clicking the “Do Not Sell Or Share My Personal Data” link at the bottom of the home page of our Websites you will learn more about this option and will have the opportunity to opt-out. 

Other Rights Regarding Your Personal Data

  1. Right to Know and Access

This means you have the right to know and request information about what Personal Data we have collected about you, the categories of this Personal Data, the categories of sources from which the Personal Data was collected, the business or commercial purpose for collecting, selling, or sharing your Personal Data, the categories of third-parties to whom we disclose Personal Data, and the specific pieces of Personal Data we have collected about you.

  1. Right to Delete

You have the right to request that we delete Personal Data we have collected from you. However, keep in mind that this right is subject to certain exceptions.

  1. Right to Correct

You can request that we correct inaccurate Personal Data we maintain about you.

  1. Right to Data Portability

You have the right to have us provide your Personal Data in a portable and ready to use format.

  1. Right Not to Receive Discriminatory Treatment

We will not discriminate against you based on your Personal Data, or for exercising your rights under California law.

  1. Right to Opt-Out of Profiling

You may have the right not to be subject to a decision based solely on automated processing, i.e., profiling, that produces legal effects concerning you or significantly affects you.

Exercising Your Rights

To exercise the rights described above, please submit a verifiable consumer request to us using one of the methods set forth below:

Response timing and format

If you exercise any of these rights, we may need to verify your identity. If we need to do so, we may ask you to provide certain information such as the license plate number and/or last four digits of a credit card associated with your account, or other information needed to verify your identity–depending on the sensitivity of the Personal Data in question. If we cannot verify your identity, we may deny your request. If that happens, we will let you know. 

You can also have an authorized agent exercise your rights on your behalf using the same methods as described above. If you do so, we may also ask your authorized agent to provide proof that they are authorized to act on your behalf, such as power of attorney or other valid written authority to submit requests to exercise rights on your behalf.

We use good faith efforts to respond to a verifiable consumer request within forty-five (45) days after its receipt. If we need more time (up to 90 days), we will inform you of the reason and the needed extension period in writing. We will deliver our written response by email or postal mail.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. If we cannot comply with any portion of a request, the response we provide will also explain why, if applicable. For data portability requests, we will select a commercially reasonable format to provide your Personal Data that is commonly usable and should allow you to transmit the information from one entity to another entity without hindrance, but we do not guarantee that all formats are usable in all media. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

You may appeal an adverse decision on your data request by emailing or writing to us using the contact details above, with the subject line: Data Subject Rights Appeal. You also have the right to lodge a complaint to your local regulator or attorney general if you are not satisfied with our response to your request or how we manage your Personal Data. However, we encourage you to contact us first so we can address your concerns directly. 

Sensitive Personal Data

ParkMobile does not use or disclose sensitive Personal Data except to perform the Services for which the information is collected. 

California “Shine the Light” law

California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing Personal Data to third parties for the third parties' direct marketing purposes. Residents of the State of California may ask us to provide them with a list of the types of Personal Data that we have disclosed during the preceding year to third parties for their direct marketing purposes, and the identity of those third parties. If you are a California resident and would like such a list, please use the contact details in the Exercising Your Rights section of this Policy. 

For all such requests, please indicate "CA Shine the Light" in the subject field of your request. You must also include your full name, email address, street address, city, state, and zip code.

Canada Privacy Rights

In addition to the other information in our Policy, this section describes the privacy rights specific to residents of Canada. 

Withdrawing Your Consent

Your knowledge and consent are required for the collection, use, or disclosure of Personal Data except where required or permitted by law. 

You may withdraw all or part of your consent for us to collect, use, or disclose your Personal Data in accordance with this Policy at any time upon reasonable notice to us in writing, subject to legal or contractual restrictions. The withdrawal of your consent may affect our ability to continue to provide you with the services and products that you have or would like to receive.

Transfer Outside Canada

At times we may transfer your Personal Data outside of Canada, including to service providers outside Canada who may perform services for us involving some of your Personal Data. This information is subject to both the laws of Canada and the laws of those other jurisdictions, including laws with respect to disclosure of such information, and may be accessible by regulatory authorities in other jurisdictions. When we transfer Personal Data to service providers, we ensure by contractual means that the transferred Personal Data is protected to the same degree as if it were in our possession.

Ensuring Accuracy and Accessibility of Your Information

We will do our best to ensure that your Personal Data is correct and kept current. If you wish to access the personal information we have about you, please email privacy@parkmobile.io or contact our Privacy Officer using the methods described above. You may also correct or change errors to Personal Data we may have about you by logging into your personal account in the mobile application or website. You are requested to notify us as soon as possible of any changes, deletions, or corrections to your Personal Data so that we may keep such information up to date.

Please note that we may be unable to provide you with full access to your Personal Data if we are prohibited by law or regulatory reasons to do so, or if the information has been securely destroyed. Subject to legal or contractual restrictions, we will provide you with an explanation if we are unable to fulfill your access request.

Access to Personal Data Within ParkMobile

Within ParkMobile, your Personal Data is accessed only by persons who require access to provide services to you.  This may include people who work in IT, marketing, finance, customer service, and our legal department.

Responding to Inquiries and Complaints

If you believe the privacy laws relating to the protection of your Personal Data or our Privacy Policy have not been respected, or if you have any questions or requests in connection with this Policy or other privacy-related matters, please send an email to privacy@parkmobile.io

If, after an investigation, your complaint is deemed justified, we will take appropriate steps to correct the situation, including, if necessary, amending our policies and practices. If you are not satisfied with the results of the investigation or the corrective measures taken by us, you may exercise the remedies available under law by contacting the Office of the Privacy Commissioner of Canada at the address below:

Rights Regarding Your Personal Data

You have the following rights regarding your Personal Data.  

  1. Right of Access

This includes your right to know that we process your personal data, and the conditions of processing.

  1. Right of Rectification

This allows you to request the correction of Personal Data that is inaccurate, incomplete, or needs to be updated.  

  1. Right of Cancellation

You can request that we suspend processing of your Personal Data to allow assessment of potential liabilities related to you.  At the end of this period, your Personal Data will be deleted.

  1. Right of Objection

You may object to us processing your Personal Data if there is a legitimate reason to believe processing may harm you.

To exercise the rights described above, please submit a verifiable consumer request to us using one of the methods set forth below:

Sensitive Data

The only sensitive data we process is geolocation, financial information, and if you enroll in our automatic license plate recognition program, your license plate number.  We do not use or disclose sensitive Personal Data except to perform the services for which the information is collected.  

Basis For Processing

We process your Personal Data to provide Services to you and also with your consent.  The purposes of processing which require your consent include: marketing, promotions, and our Automated License Plate Recognition program (if you enroll).  When you provide your Personal Data which is required for us to provide Services to you, you are also consenting to ParkMobile processing your Personal Data. You may withdraw your consent for the processing of your Personal Data at any time by contacting us using any of the methods described above. The withdrawal of your consent may affect our ability to continue to provide you with the Services and products that you have or would like to receive.

How We Make Changes to This Policy

We may change this policy from time to time in our sole discretion without prior notice to you. The most current version of this Policy will govern our collection, use, and disclosure of Personal Data we maintain about you. You are responsible for periodically reviewing this Policy for changes. If you continue to use our Services after those changes are in effect, you agree to the terms of the revised Privacy Policy. If the changes are significant, we may provide a more prominent notice or obtain your consent, if required by law.
